Subject of the agreement
posaktif.nl / chatturk24.com is a service provision that regulates contacts on the Internet via a platform. By completing and submitting the registration form of posaktif.nl or the previous website, you do not become a member but you declare your agreement to these Terms and Conditions. This agreement may be modified by posaktif.nl at any time. If the customer does not object to the changes within two weeks after payment for a service or if they continue to use posaktif.nl's services despite the reference to the changes, the changes become effective with respect to the customer. Should a user not agree with the latest version of these General Terms and Conditions, they are free to terminate the agreement in accordance with their terms and conditions. When you purchase using a credit card, the unobtrusive text appears on your statement: posaktif.nl or chatturk24.com.

System descriptions
The access occurs via registration. Customers can purchase credit with their credit card. The amount will be debited from the credit card immediately with the statement "posaktif B.V." or "chatturk24.com". Posaktif B.V. also reserves the right to check the data which you provided. You can get in touch with other people in proportion to the amount of your credit. Your credits do not expire and there is no obligation to make new bookings. We work exclusively with the 3D-Secure procedure.

Cancellation
Your access and deletion of your data can be terminated at any time, without giving reasons, by us or by you. Posaktif B.V. must have received a notification either by telephone or by electronic or conventional mail. You can find the contact details in the imprint. posaktif.nl is not responsible for misdirected, delayed, invalid or lost cancellation letters or e-mails by post. Cancellations will be confirmed in writing by posaktif.nl to the e-mail address provided during registration. In case of doubt, you must provide proof that you have sent a notice of termination or received a confirmation of termination.

Obligations of the user
The use may not be shared with or transferred to other persons. The user must inform posaktif.nl immediately of any obvious breach of security, such as loss, theft or unauthorised use of a user name, password or credit card details. Until Posaktif B.V. is notified of the breach of security by e-mail or telephone, the user is responsible for any unauthorised use of the service. The member is responsible for the provision and configuration of computers and communications equipment, software or plug-ins required to access the service or use the content of the service. Access to the service and use of the service is through a combination of a user name and password. Every member must treat their access data in a strictly confidential manner. Do not forget your password! Unauthorised access to the service is a violation of this agreement and is a criminal offence.

Liability
Any unlimited liability of the service for loss of performance, error, omission, interruption, deletion, defect, delayed transmission, failure of communication line, theft of records, destruction of records, unauthorised access to records, manipulation of records or use of records, either as breach of contract, carelessness or negligence or in any other case, is strictly limited.

Warranties
All contents are tested and executable with standard configurations of the current browser versions of Microsoft© on PC basis. The user is responsible for their PCs, network, Internet access and possibly additionally installed software and plug-ins. Due to the multitude of possible error configurations, posaktif.nl hereby disclaims all warranties relating to the following: all warranties for the availability, compatibility, completeness, content of the information, products or services, all warranties of usability or fitness for use for a specific purpose.

Notifications
All notifications from posaktif.nl to the user can be sent as an electronic message (e-mail), as a general publication on the pages or by conventional mail. User notifications may be sent by electronic message, conventional mail or telephone. All questions, complaints or notifications to the service must be sent by e-mail to the following address, stating the pseudonym: mail@posaktif.nl .

Youth protection regulations
The user assures that, according to the laws of his country, they is over 18 years old and therefore of full legal age, as well as fully contractually capable, in order to be able to enter this agreement in all points in a qualified and competent manner. Furthermore, the user undertakes not to intentionally grant minors access to the service and is themselves liable for the secrecy of the access data provided to them with respect to minors, family members, friends or acquaintances. Upon request, the member will prove their age of majority by presenting a copy of their passport or identity card, as well as a copy of the account or credit card used for registration.

Data protection
The user authorises Posaktif B.V. to store personal, billing and provider or access data. However, this information will not be disclosed to unauthorised third parties and will only be disclosed if requested by higher legal authorities. Furthermore, the user authorises the service provider to notify any updates by e-mail.

Chat systems
The service provider can allow private message exchange. We point out that all messages or conversations you have entered can and could be requested by the operators of this site, regardless of whether or not they should be the recipients of the message. Users agree not to transmit, publish or otherwise display any defamatory, untrue, offensive, threatening or otherwise illegal content. Refund

The revocation period ends after expiry of 14 days. Please contact your bank if your card is misused. Our system works with the 3-D Secure from Mastercard. Refunds of payments with our Secure System are only valid if our service was not complete or faulty. Reasons for this can be a server failure or incorrect programming in the website, so that no contact has been made. Purchased minutes cannot be refunded if there is no special reason (reasons are not: minutes no longer needed due to lack of interest or possibilities of use). Bought minutes do not expire. In the event that the web pages operation is discontinued, an agreement will be concluded with you in individual cases. This can be the transfer of your minutes or the withdrawal of your credit.

Storing of data
We only store the information that you provided during registration. No data about your bank details or your credit cards will be stored. Credit card details are only sent directly to our service provider via a secure SSL connection. This uses the necessary PCI certificates to process your data properly and securely. We will not disclose your personal data to third parties. Our server has several security functions, such as SSL, PCI compliance, firewall, storage of your profile data as hash value, etc. The access to credit card data during payment from outside is excluded. Under no circumstances should you disclose credit card information to acquaintances, third parties or people in the chat.

Other
If any provision of this agreement is proven to be invalid, then this shall not affect the validity of the remaining provisions. In lieu of the invalid provision there will be a close substitute provision appropriate to the agreement, which the parties would have agreed in the interests of achieving the same economic outcome if they had known about the invalidity of the provision. The same applies to the incompleteness of the provisions. The place of jurisdiction is the Netherlands.
